We are liable without limitation for damages arising from intentional or grossly negligent breaches of duty by us or by one of our legal representatives or agents, regardless of the legal basis.
In the case of simple or slight negligence, we are liable only:
without limitation for damages resulting from injury to life, body, or health;
for damages resulting from the breach of essential contractual obligations. Essential contractual obligations are obligations whose fulfillment is necessary for the proper performance of the contract and on whose compliance the customer regularly relies and may rely. In this case, liability is limited to the damage foreseeable at the time of contract conclusion and typical for the contract.
The above limitations of liability do not apply if we have fraudulently concealed a defect, assumed a guarantee for the quality of the goods, or assumed a procurement risk. Mandatory statutory liability, in particular under the German Product Liability Act, remains unaffected.
To the extent that our liability is excluded or limited under the above provisions, this also applies to the personal liability of our corporate bodies, legal representatives, employees, staff, and agents.
